Supreme Court returns to Texas, Louisiana case on Biden admin prioritizing migrants for deportation

The Supreme Court will revisit a case Tuesday to decide whether the Biden administration has the power to prioritize the deportation of certain illegal migrants deemed to be a national security or public safety threat.

The high court temporarily blocked President Joe Biden's deportation strategy in July with plans to hear arguments later in the year, according to USA Today

Biden's plan, which would make other immigrants less of a priority for deportation, is a change from the Trump administration's policy to remove a wider category of migrants. The attorneys general for Texas and Louisiana filed a lawsuit over the plan, arguing the president does not have the authority to make the policy without congressional authorization. 

The states also said Biden's plan is more costly.

"We do not have a money tree in the backyard, nor can we print money," Louisiana Solicitor General Liz Murrill said. "Any argument that our position on illegal immigration is somehow in conflict with a policy of encouraging growth in our states is falsely equating two things that are wildly dissimilar."
