Abrego Garcia's case is at the center of a legal battle over his removal, which the administration has admitted was due to an "administrative error." He is not an American citizen and is a suspected member of the MS-13 gang. El Salvadoran President Nayib Bukele has declined to return him to the United States.

Abrego Garcia resided in Maryland but was subject to a withholding order preventing his deportation. Van Hollen has expressed outrage and traveled to El Salvador, but was unable to obtain a meeting with Abrego Garcia.
