Trump yanks federal support for youth gender transitions, including in military health insurance

Tasks DOJ with taking action against "sanctuary states" that "facilitate stripping custody from parents who support the healthy development of their own children," working with Congress to let children and parents sue doctors.

President Trump signed a sweeping executive order Monday night, titled "Protecting Children from Chemical and Surgical Mutilation," that turns the full force of the federal government against so-called gender affirming care for children, including against doctors that perform it and states that facilitate it.

"Across the country today, medical professionals are maiming and sterilizing a growing number of impressionable children under the radical and false claim that adults can change a child’s sex through a series of irreversible medical interventions," the order says. 

Not only will "countless children soon regret" their medical transitions, inability to conceive and breastfeed, but their "medical bills may rise throughout their lifetimes, as they are often trapped with lifelong medical complications, a losing war with their own bodies, and, tragically, sterilization," it says.

The U.S. will stop funding, sponsoring, promoting, assisting or supporting gender transitions via puberty blockers, cross-sex hormones and surgical interventions to make minors resemble the opposite sex, genital or otherwise, and scrub all reliance on the "junk science" of the World Professional Association for Transgender Health and its controversial Standards of Care 8, which were covertly shaped by former Assistant Secretary of Health Rachel Levine.

The secretary of health and human services is tasked with publishing a "review of the existing literature on best practices" for treating youth gender dysphoria, its rapid-onset variety and "other identity-based confusion" within 90 days, and increasing "the quality of data to guide practices for improving the health" of those minors.

Each agency that provides research or education grants to medical schools and hospitals will force them to "end the chemical and surgical mutilation of children" as a condition of keeping funding, and the HHS secretary will use "regulatory and sub-regulatory actions" to end that treatment, such as through Medicare and Medicaid conditions and federal funding for the Diagnostic and Statistical Manual of Mental Disorders.

The HHS secretary and attorney general will together "issue new guidance protecting whistleblowers who take action related to ensuring compliance with this order."

The secretary of defense will commence regulatory action to exclude the treatment from the military health insurance plan Tricare, and the Office of Personnel Management will ensure that eligible carriers for federal employee health benefits exclude it as well.

The AG will review DOJ enforcement of federal law against "female genital mutilation" and prioritize enforcement, convene state AGs to coordinate enforcement and prioritize investigations of entities "misleading the public about long-term side effects of chemical and surgical mutilation" in violation of the Food, Drug, and Cosmetic Act.

The order tasks the AG to consult with Congress on legislation to give children and parents a "private right of action" with a "lengthy statute of limitations" to sue medical professionals who have harmed their "healthy body parts" via gender affirming care.

The AG will also take action against "sanctuary states" that "facilitate stripping custody from parents who support the healthy development of their own children, including by considering the application of the Parental Kidnapping Prevention Act and recognized constitutional rights."
