Special counsel Jack Smith requests court pause appeal against Trump in classified documents case

This comes shortly after the news of Smith stepping down before Trump takes office.

Special Counsel Jack Smith requested that an appeals court pause his appeal against President-elect Donald Trump in the classified documents case.

Fox News obtained the documents of Smith's request. 

Smith specifically requested the court "hold this appeal in abeyance" until Dec. 2, 2024.

This comes shortly after reports that Smith plans to step down before Trump takes office.

In 2022, Smith brought a case accusing Trump of improperly taking classified documents back to his estate Mar-a-Lago in Florida.
