DOJ files federal charge against convicted illegal California migrant set to be released early

Ortega-Anguiano was initially sentenced to 10 years in prison for the crimes, but will now be released in July, meaning he will have served just 3.5 years of the sentence.

The Justice Department on Wednesday filed federal immigration charges against an illegal migrant in California who is being released from prison early, despite a double manslaughter conviction. 

Oscar Eduardo Ortega-Anguiano was convicted on two counts of gross vehicular manslaughter while intoxicated in 2022, after he crashed his car into another vehicle while recklessly speeding and driving while high and drunk. The crash killed the two people, 19-year-olds Anya Varfolomeev and Nicholay Osokin, who were in the other car, per Fox News.

Ortega-Anguiano was initially sentenced to 10 years in prison for the crimes, but will now be released in July, the outlet reported. The new release date means he will have served just 3.5 years of the sentence.

Bill Essayli, United States Attorney for the Central District of California, said in a post on social media that he has now filed a "felony immigration charge" against Ortega-Anguiano. 

"My office has filed a felony immigration charge against this defendant," Essayli posted on X. "He faces up to 20 years in federal prison if convicted for 8 USC 1326. If the State of California will not seek the full measure of justice against this individual, the [DOJ] will."

Attorney General Pam Bondi and Border czar Tom Homan also weighed in on the case, stating they will work with federal immigration officials to get the man deported if he is released from prison early.

"I will work with [Homeland Security] Secretary [Kristi] Noem on this case, and I guarantee you, if they don’t honor the detainer, we’ll have ICE agents outside that facility to take custody of this individual and deport him," Homan told the outlet.
