Family of slain Jan. 6 Capitol rioter sues to learn the identity of the officer who killed her

The family of Ashli Babbitt, one of the participants in the Jan. 6 Capitol riot and the only individual known to have been killed during the chaos of the day, are suing to learn the identity of the U.S. Capitol officer who fired the gun that killed her. 

In the lawsuit, Babbitt's widower, Aaron Babbitt, noted that the Washington, D.C. Metropolitan Police Department has failed to respond to a FOIA request he filed seeking information on the Capitol officer who pulled the trigger. 

Babbitt in the suit demands a variety of documents and materials from the police department, including “documents that identify the officer or person who shot Ashli Babbit in the incident,” as well as “notes and summaries of what the officer said regarding the shooting” and “police training records of the shooting officer.”

The suit states that both the police department and D.C.'s mayor failed to properly address the FOIA request.

Babbitt asks the court to compel the police department to comply with the FOIA; he also asks for attorney’s fees as well as “such relief as the Court deems just and proper.”
