Dominion can't discuss Jan. 6 in Fox News suit, judge rules
Dominion is seeking $1.6 billion in the suit.
Dominion Voting Systems may not discuss the Jan. 6, 2021, Capitol riot as part of its defamation suit against news outlet Fox News, a judge has ruled.
On Tuesday, Delaware Superior Court Judge Eric Davis determined that any discussion of Jan. 6 could affect the jury's view of the case in a manner separate from the allegations Dominion has made against the network, The Hill reported.
Dominion contracts with local municipalities to provide voting equipment for elections. The company became the subject of intense scrutiny in the aftermath of the 2020 presidential election and amid former President Donald Trump's claims that rampant voter fraud affected the outcome.
The company has sued the Fox network over its negative coverage of the firm in the context of Trump's narrative, alleging that the network aired false information about its software. Davis, in March, allowed the suit to proceed to trial.
He also determined in that ruling that Dominion had proven the first element of its allegation, namely that Fox reported false information about the company.
"Dominion has offered proof demonstrating that the allegations were substantially false," he wrote at the time. "Comparing the allegations at issue to the truth, the truth would have likely had a different outcome on the average viewer, as the statements at issue were dramatically different than the truth."
Dominion is seeking $1.6 billion in the suit.
