Abortion pill provider asks Supreme Court to block lower court ruling blocking access to drug

The company makes Mifeprex, which is an abortion pill that blocks a hormone called progesterone that is needed for a pregnancy to continue

A pharmaceutical distributor that produces the abortion drug mifepristone, requested Friday that the Supreme Court block the recent court decision that prevents pregnant women from obtaining the pill by mail.

Danco Laboratories located in Manhattan, New York, asked the Supreme Court to block the decision made by Texas U.S. District Judge Matthew Kacsmaryk who ruled that the Food and Drug Administration (FDA) improperly rushed the approval process for the pill, violating federal standards.

Danco Laboratories argued their company would be "irreparably harmed" by this decision because it "will be unable to both conduct its business nationwide and comply with its legal obligations."

The pharmaceutical distributor makes Mifeprex, which is an abortion pill that blocks a hormone called progesterone that is needed for a pregnancy to continue.  

The Biden administration has also asked the Supreme Court to intervene with the Texas judge's decision. 

U.S. Attorney General Merrick Garland issued a statement in support of the FDA.

"The Justice Department strongly disagrees with the decision of the District Court for the Northern District of Texas in Alliance for Hippocratic Medicine v. FDA and will be appealing the court's decision and seeking a stay pending appeal," the statement reads.
